SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The record contains a properly constituted DD Form 214 (Certificate of release or Discharge from Active Duty). His DD form 214 indicates that he was discharged under the provisions of Chapter 4, AR 600-8-24, unacceptable conduct with a characterization of service of general, under honorable conditions.

         b. On 9 October 1998, the applicant was discharged. At the time of discharge, the applicant had completed 3 years, 8 months, and 14 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 600-8-24 sets for the basic authority for Officer transfers and discharges. Chapter 4 outlines the policy and procedure for the eliminating officer from the active Army for substandard performance of duty, misconduct, moral or professional dereliction, and the interest of national security.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. All the facts and circumstances leading to the applicant’s discharge were not available for the Board’s review. However, the record does contain the applicant’s voluntarily request for resignation in lieu of elimination. This request was approved by the appropriate authority with issuance of a general, under honorable conditions discharge. The Board concluded that by his misconduct, the applicant diminished the overall quality of his service below that meriting a fully honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
